Electronic Communications Disclosure and Agreement

This agreement sets forth the terms and conditions under which you may elect to receive periodic statements, legal notices, tax information returns and related statements, and other communications electronically.  These terms and conditions affect your rights and you should read them carefully.  By checking the ‘agree’ box below, you are agreeing to the terms and conditions of this agreement and hereby give your affirmative consent to the delivery of electronic communications, tax information returns, and related statements.  You further agree and acknowledge that you have confirmed your ability to receive and retain electronic communications, tax information returns, and related statements in the manner described below.   

This consent for electronic statements and forms will pertain to certain US federal tax information returns, including, but not limited to, internal revenue service forms 1099-R, 1099-INT, 1099-Misc, 5498, 1099-Q and 1098, as well as to any US state and local equivalent tax information return.

If you do not consent to receive communications, tax information returns, and related statements electronically, paper copies will be provided to you.  

If you do consent to receive periodic statements, tax information returns and related statements, and other communications electronically, this consent shall apply to every year that the periodic statements,  tax information returns and related statements, and other communications are furnished, and shall continue indefinitely until you advise UNFCU in writing (by mail or electronically as set forth below) that you withdraw such consent.   Further, even after giving such consent, you may still receive a paper copy of these items by submitting a written request to UNFCU in the manner described below.

This Electronic Communications Disclosure and Agreement (the “Agreement”), applies to all periodic statements,  tax returns and related statements, and other communications  for all of your accounts, products and services with United Nations Federal Credit Union (“UNFCU” or “we”) as of the date of your consent, including, but not limited to, ACH Service, External Transfer, Mobile Deposit, Mobile and Digital Banking accessible through www.unfcu.org (“Digital Banking”), Account to Account Transfers, POPMoney and BillPay Services (the “Services”).  The words “I”, “you”, and “your” shall mean each member and/or service user identified on an account.

We recommend that you download a copy of this Agreement for your records. By signing this consent, you agree and acknowledge that you have received a copy of this Agreement electronically.  UNFCU will mail you a hard copy of this Agreement upon request.

Types of Electronic Communications

In accordance with the federal Electronic Signatures in Global and National Commerce Act (“E-Sign”) and regulations governing the electronic issuance of recipient copies of US federal and state tax information returns and related statements as set forth in the US Internal Revenue Code and governing local laws, upon the delivery of this Agreement and your consent, UNFCU may provide you with information, tax returns, and related statements, and other communications that are required in writing under certain laws and regulations electronically.  This information includes all legal or regulatory disclosures, tax information returns and related statements, periodic statements, privacy policies and notices, changes to terms and conditions, or any other disclosures or notices regarding the Services (together, the “Communications” and each a “Communication”). Certain UNFCU accounts, products or services require your consent to this Agreement as they are provided solely through electronic means.

Method of Delivery

If you agree to the terms of this Agreement, UNFCU may send electronic Communications by any lawfully permitted electronic manner, including posting them on UNFCU’s website, through links provided on Internet Banking or elsewhere, by email sent to the primary email address you have provided to UNFCU, or any combination of these means.  You agree to no longer receive paper copies of the Communications via postal mail.   However, UNFCU reserves the right to send paper copies of the Communications to you at any time in its sole discretion.  UNFCU also reserves the right to deliver the Communications to any other email address you have provided if a Communication sent to your primary email address is returned undeliverable.

Tax returns and related forms will be posted on UNFCU’s website on or before January 31 or the applicable due date of the return.  UNFCU will notify you of the availability of the tax returns and related forms on Digital Banking, electronically or by mail, and provide instructions on how to access and print the tax documents.  The tax returns and related forms will remain accessible on Digital Banking at least until October 15 of the same year. 

Hardware and Software Requirements

In order to access, view, and retain electronic Communications you must have access to a personal computer and/or mobile device equipped with at least an operating system capable of accessing the internet and downloading HTML, ASPX and/or PDF files; a browser that supports 128-bit encryption; Adobe Acrobat Reader 6.0 or higher; and either a printer or disk drive or other electronic storage device.

Withdrawing Consent

You may withdraw your consent to the delivery of electronic Communications at any time using the methods described below.

Requests for paper Communications can be processed by clicking on ‘Account Services’ within Digital Banking followed by ’Statement Options.’  Within the ’Statement Options’ screen, click on ’Change to Paper Statements.’  A change to paper Communications through Digital Banking will be processed immediately.

Please note, withdrawing consent by mail may take up to sixty (60) business days to be processed and to start receiving Communications via postal mail.

There is no charge for revoking your consent; however, you may be charged a fee for receiving paper Communications. Please contact UNFCU at +1 347-686-6000 for further details

Withdrawal of your consent may result in un-enrollment from one or more of the Services.

Requesting Paper Copies

Communications may be printed, free of charge, via Digital Banking.  You may also request a paper copy of a Communication by contacting UNFCU at +1 347-686-6000.  You may be charged a fee for receiving paper account statements more than six (6) months old.  Please contact UNFCU at +1 347-686-6000 for further details.   

Update Contact Information

As part of this Agreement, you must provide UNFCU with a valid email address.  By agreeing to this Agreement, you agree to maintain a current and valid email address and to update your email address and contact information as necessary.  If your email or any of your contact information changes, you agree to promptly update your information by clicking on the ’Contact Details’ form available within Digital Banking or by contacting us at +1 347-686-6000.

Rejection of Electronic Communications

You understand and agree that a valid email address is essential for us to effectively send you electronic Communications.  If we attempt to send an electronic Communication to you and it is rejected, we may suspend email Communications until you update your email address using the ‘Contact Details’ form available within Digital Banking or by contacting us at +1 347-686-6000.  If you do not update your email address within sixty (60) days of a rejected electronic Communication, your account may be changed to receive Communications by mail and certain fees may apply.

Service Changes

UNFCU reserves the right, in its sole discretion, to change the provisions of this Agreement at any time.  UNFCU will provide you with notice of any changes as required by law.

Miscellaneous

If any provision of this Agreement is held to be invalid or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be invalidated or otherwise affected.  The terms and conditions of this Agreement are in addition to and part of the terms and conditions of the agreement governing the use of Digital Banking, and are in addition to all other terms and conditions in agreements governing your accounts with us and constitute an amendment of those other agreements as their provisions relate to delivery of Communications.
